1. INTRODUCTION
Accessing and using this website implies full and unconditional acceptance of these Terms and Conditions, which are complemented by the Privacy Policy, Cookie Policy, and other provisions related to Data Protection, all drafted in accordance with the applicable legislation governing electronic commerce.
The present Terms and Conditions, together with the order form and other referenced documents, establish the rules and conditions governing the provision of services offered by this online store, operated by BERRYBOSS Unipessoal LDA, headquartered at Rua de Alvre, no. 14, 4740-013 Esposende, Portugal, Tax Identification Number (NIF) 518 631 583, hereinafter referred to as "Glowthie".
Glowthie reserves the right to modify or update these Terms and Conditions without prior notice, in order to correct any inaccuracies, incorporate improvements, or comply with legal changes.
Glowthie shall not be held responsible for interruptions in the operation of the website, which may occur for technical reasons, maintenance, or to comply with legal requirements. Some functionalities may be limited or temporarily unavailable due to circumstances beyond the company's control.
 
2. DEFINITIONS
  • Client: A natural person over 18 years of age or, in the case of minors, duly authorized by their legal representatives.
  • User: Any individual who accesses Glowthie's website to consult information or interact with the services offered.
  • Personal Data: Any information that identifies or allows the identification, directly or indirectly, of a natural person, including but not limited to, name, email address, phone number, or IP address.
  • Intellectual Property: All content made available on the website, including texts, images, logos, and other materials, belongs exclusively to Glowthie or is used under license. The use of this content is permitted only for personal purposes, and any reproduction, distribution, or commercial use without prior written authorization is strictly prohibited.
  • Data Controller: The entity responsible for the collection and management of personal data, in accordance with the General Data Protection Regulation (GDPR).
3. OBJECTIVE OF THE SERVICE
The service provided by Glowthie consists of the operation and maintenance of a digital platform accessible at www.glowthie.com. This platform allows Clients to:
  • Consult detailed information about the products and services offered;
  • Place orders electronically, under the terms established in these Terms and Conditions.
Transactions carried out on the website have full legal validity, and the electronic communications and documents associated with the Client's orders are recognized as legally binding. By using the service, the Client accepts that finalizing an electronic order constitutes a binding contractual obligation, and the absence of a physical signature cannot be used as justification for failing to comply with their legal or contractual obligations.
 
4. PRODUCT INFORMATION AND CONTENT
Glowthie is committed to ensuring that all information displayed on the website is accurate and free from typographical errors. However, if such errors occur, they will be promptly corrected. If the Client purchases a product with characteristics that differ from those displayed online, they have the right to terminate the purchase contract under the terms provided by applicable law.

It is important to note that certain products may be shipped in packaging that predates the most recent versions released by the manufacturer, without affecting the product's formulation or quality. Such occurrences do not constitute a lack of conformity.
The images of products displayed in this online store are intended solely to facilitate the Client's visual identification of the product. However, due to updates made by manufacturers, the images may not fully correspond to the item received. Consequently, these images are merely illustrative and should not be interpreted as a binding representation of the product’s characteristics.
 
Glowthie is committed to making every effort to ship all the products ordered. However, in exceptional situations, such as human errors or system failures, it may not be possible to fully fulfill the order. If a product is unavailable after the purchase has been completed, the Client will be duly notified by email. In this case, the Client will be offered the option to cancel the order, and if payment has already been made, the corresponding refund will be processed.
All information regarding prices, products, specifications, promotions, and services is subject to change at any time by Glowthie, without prior notice.
Payments made through the website are processed exclusively in euros (€). Any exchange rate fees charged by financial or banking institutions are the sole responsibility of the Client.
 
The products, information, and services provided by Glowthie are for informational purposes only and do not replace medical or pharmaceutical guidance. Before purchasing or using any product, the Client should consult a qualified healthcare professional and review the detailed information provided by the manufacturer.
Glowthie does not endorse products, services, or content from third parties that may be mentioned on the website or accessed through hyperlinks contained therein. The company is not responsible for the accuracy, legality, or quality of such third-party materials.
 
5. RESPONSIBILITIES
Glowthie ensures that appropriate security measures are in place to protect the website and the transactions carried out on it. However, Glowthie shall not be liable for any damages caused to the Client or third parties resulting from delays, interruptions, errors, or failures in communications arising from factors beyond its control. These factors may include, but are not limited to, deficiencies or failures in the communication network, services provided by third parties, computer systems, modems, connection software, or computer viruses that may be transmitted via the download of infected files or files with properties that may compromise the Client's equipment. In the event of any access errors to Glowthie’s website that prevent the provision of the service, Glowthie shall not be held liable for any damages or losses arising from this failure.
 
5.1 Use of Data and Information
Data and information queries made through this service are presumed to be carried out by the Client. Glowthie is not responsible for any misuse or fraudulent use of the information obtained.
 
5.2 Liability for Abusive Use
Glowthie shall not be liable for any losses or damages caused by misuse of the service, except where such actions are directly attributable to Glowthie through willful misconduct or gross negligence.
 
5.3 Limitation of Liability
Glowthie shall not be liable for any damages or losses resulting from the failure to provide the service, where such failures are not directly or indirectly attributable to Glowthie through willful misconduct or gross negligence. In particular, Glowthie shall not be held responsible for:
  1. Errors, omissions, or inaccuracies in the information provided through the service;
  2. Damages caused by the Client or third parties, including intellectual property rights violations;
  3. Non-performance or defective performance of the service due to compliance with court rulings or administrative authority decisions;
  4. Non-performance or defective performance resulting from force majeure events, i.e., extraordinary or unforeseeable events beyond Glowthie’s control that prevent or hinder the fulfillment of its obligations. Such events may include, but are not limited to, fires, power outages, explosions, wars, riots, civil unrest, government decisions, strikes, earthquakes, floods, other natural disasters, or any other circumstances beyond Glowthie’s control.
5.4 Service Warranties
Glowthie does not guarantee that:
  1. The service will be provided uninterruptedly, securely, error-free, or indefinitely;
  2. The quality of any product, service, information, or material obtained through the service will meet the Client's expectations;
  3. Any material obtained through the service will be used at the Client's own risk, and the Client shall be solely responsible for any damage caused to their system or computer equipment, or for any data loss resulting from such operation;
  4. Any advice or information, whether oral or written, obtained by the Client through the service will create warranties beyond those expressly described in these general conditions.
5.5 Disclaimer of Liability for Damages
The Client acknowledges and agrees that Glowthie shall not be held liable for any damages, including but not limited to loss of profits, loss of data, loss of content, or any other loss, even if Glowthie has been informed of the possibility of such damages. Such damages may result from:
  1. The use or inability to use the service;
  2. Difficulties in obtaining substitute goods or services;
  3. Unauthorized access to or modification of the Client's personal data.
6. CONSUMER OBLIGATIONS
6.1. Client Commitments
The Client agrees to:
  1. Provide accurate and complete personal information and addresses;
  2. Refrain from using false or misleading identities during the purchase or registration process;
  3. Respect the order limits established by Glowthie.

6.2. Incorrect or Insufficient Data
If any of the information provided by the Customer is incorrect or insufficient, causing delays, the inability to process the order, or non-delivery, the responsibility shall lie solely with the Customer, exempting Glowthie from any liability.

If, due to incorrect or insufficient data, the undelivered order is returned to our facilities, the option for a refund of the amount paid for the products, excluding shipping fees (if paid by the Customer), will be offered. In cases where the shipping fees were covered by Glowthie, a fixed fee of €4.50 (Mainland Portugal), €6.50 (Portugal - Islands), or €9.99 (other destinations) will apply.

6.3. In the event of a violation of any of the aforementioned obligations, Glowthie reserves the right to:

  1. Block or delete the Client's future purchases;
  2. Restrict access to the online store and/or Glowthie’s services;
  3. Cancel the provision of any services being simultaneously rendered to the Client;
  4. Deny the Client future access to any services offered by Glowthie.
7. PAYMENT METHODS AND ORDER CANCELLATION
When an order is placed through the Client's personal account on the Glowthie platform, the purchase is recorded, and the Client is granted a specific period, depending on the chosen payment method, to complete the payment. If payment is not confirmed within the stipulated time and the payment-on-delivery option is not available, the order will be automatically canceled.
 
7.1. Available Payment Methods
Glowthie offers several payment options to ensure security and flexibility in all transactions. Certain payment methods may allow the storage of information necessary for future transactions. However, such information is not stored or managed directly by Glowthie. The management of such information is carried out by the payment service provider. When allowed by the service provider, the management of stored payment data may be done directly on the website, always in compliance with applicable legal standards, including the General Data Protection Regulation (GDPR).The payment methods available on Glowthie's platform include:
  • MB WAY
    Clients can make payments using the MB WAY app. To do so, they must select this method during the checkout process, enter the mobile phone number associated with the app, and follow the confirmation steps. It is essential to complete the payment within the five-minute time limit. Otherwise, the order will not be finalized

  • Credit Card
    Payments can be made using credit cards under the terms offered by the Client's bank. To complete the transaction, the Client will need to provide card details (card number, expiration date, CCV code, and cardholder name). For security reasons, additional validations may be required if the information provided presents inconsistencies or risks. In the event of total or partial cancellation of orders, the corresponding amounts will be refunded according to the processing times of the banking institution or card issuer.

  • Multibanco Reference
    The Client can choose to pay via the Multibanco Reference system, a practical and secure post-payment method. When selecting this option during the checkout process, a unique reference will be generated consisting of three elements: entity, reference, and amount. This information will be displayed at the end of the purchase process and sent to the Client via email. Payment Deadlines: The payment must be made within the period indicated during the purchase process. If the deadline expires without completing the transaction, the order will be automatically canceled. To revalidate the purchase, the Client will need to place a new order. Note: The Multibanco system does not allow direct refunds to the Client's bank account. In the event of a return or order cancellation, the refund will be processed either as store credit or transferred to the Client's bank account upon provision of the necessary bank details.
Other Payment Options
Depending on the delivery country, other payment methods may be available, such as:
  • PayPal: Ideal for fast and secure transactions.
  • SEPA Bank Transfers: A traditional method for transfers within the European area.
The payment methods available will be displayed during the purchase process. Due to logistical constraints or other international conditions, not all options may be available simultaneously.Notice: Payments made on the website are always processed in Euros (€), even if prices are displayed in other currencies. Certain banking institutions may charge currency conversion fees. Glowthie does not assume responsibility for such fees.Transaction Security

All operations carried out on Glowthie’s website are protected by SSL (Secure Sockets Layer) encryption technology, ensuring the security and confidentiality of the transmitted information. Furthermore, Glowthie uses advanced fraud detection systems to ensure transactions are legitimate and to protect Client data.If a transaction is deemed suspicious, Glowthie reserves the right to reject it and to immediately report any fraudulent activity to the appropriate authorities.

7.2. Order Cancellation
The Client may cancel their order only if it has not yet been paid or processed. To do so, the Client must access the "Orders" section in their personal account, select the order they wish to cancel, and click the "Cancel Order" button. After selecting the cancellation option, a message will be displayed requesting confirmation of the Client’s intention to cancel. This process is irreversible.Notice:
The order cancellation may also be requested via email or phone call, provided that the order has not yet been processed. However, requests made through these means may not be fulfilled. Cancellation is only guaranteed if carried out through the procedure described above in the Client’s personal account area.

8. DELIVERY PROCESS
8.1. Shipping Confirmation and Tracking
Once the order is shipped, the Client will receive an email containing:
  • The corresponding invoice;
  • The tracking number;
  • A link to track the delivery on the courier's website.
Important Note: Tracking information may not be available immediately after shipping. The update on the courier's system may take up to 48 hours, which is beyond Glowthie's control.Orders are delivered Monday through Friday, excluding local or national holidays, to the address specified by the Client at the time of purchase.

8.2. Delivery Options
Glowthie offers different delivery options, subject to the following factors:
  • Geographical location of the recipient: The availability of delivery options may vary depending on the region.
  • Selected delivery method: Delivery can be made to the specified address or a pick-up point.
  • Payment method validation: Certain delivery options may depend on the payment method selected.
8.3. Delivery Deadlines
Estimated delivery times are indicated on the "Shipping and Returns" page of Glowthie's online store. These deadlines are approximate and may be affected by:
  • Unforeseen circumstances, such as strikes or adverse weather conditions;
  • High order volumes during promotional campaigns or festive periods.
Note: Delays caused by external factors do not constitute a contractual breach by Glowthie.

8.4. Shipping Costs
  • Shipping fees are automatically calculated during the purchase process based on:
  • The weight and dimensions of the order;The total purchase value;
  • The delivery address location.
Orders that exceed a certain value may qualify for free shipping.

8.5. Shipping Cost Refund
Shipping fees paid by the Client may be refunded under the following circumstances:
  1. Delivery failure: If the order is not delivered due to an error attributable to Glowthie or the courier, the shipping fees will be fully refunded.
  2. Product error or defect: If an order contains incorrect or defective items, the shipping fees will be refunded along with the order amount.
Refunds will be made using the original payment method or, at the Client's request, converted into store credit, valid for 12 months.

8.6. Additional Information

If the delivery address provided by the Customer is incorrect or incomplete, delivery may not be possible, and the order will be returned to Glowthie, resulting in additional costs for the Customer, including the non-refund of shipping fees paid. If shipping was offered for free, an additional fee will be charged: €4.50 (Mainland Portugal), €6.50 (Portugal Islands) or €9.99 (other countries).

For all deliveries, one or two delivery attempts will be made at the provided address. If delivery is not possible due to the Customer’s lack of response, attention, or cooperation, the order will be dropped off at the nearest pickup point, and the Customer will be properly informed. The Customer must collect the order within the timeframe set by the carrier. If not collected in time, the order will be returned to Glowthie, generating additional costs for the Customer, including the non-refund of shipping fees paid or, if shipping was free, an additional fee of €4.50 (Mainland Portugal), €6.50 (Portugal Islands) or €9.99 (other countries).

Security Tip: After discarding the package, it is recommended to erase or destroy any personal data printed on the shipping label to prevent unauthorized access.

8.7. Conditions for Receiving Orders and Claims for Transport Damages
At the time of delivery, the Client should check the package. If it is visibly damaged, it is advisable to refuse the order. Accepting a visibly damaged package may affect the ability to file a claim later.Alternatively, if the Client notices any anomalies or damages when receiving an order, they should request that the courier register a reservation on the delivery receipt or waybill. Useful remarks may include: "Package with crushed corners", "Package with visible damage", "Package in poor condition", "Package appears to have been opened"

Attention: If no reservation is made at the time of delivery, Glowthie may not be held responsible for any damages caused during transport.

Claims for transport damage will be accepted within 48 hours after receipt of the order. The claim must include the following:

  • A photo of the exterior of the package showing the courier’s label;
  • A photo of the exterior of the package clearly displaying the damage;
  • A photo of the package's interior;
  • A photo of the damaged item(s).

The absence of these photographs may result in the transport company or insurer rejecting the claim. Glowthie will only process returns after damage verification. The damaged items must remain in the Client’s possession for collection. If the items are not available at the time of collection, no refund will be granted

8.8. Undelivered Orders
If an order is not delivered within the expected timeframe, the Client must contact Glowthie's Customer Support service within two (2) business days from the expected delivery date. The Client must provide detailed information about the order, including the tracking number and any relevant details, such as attempted delivery or the order's location.
If the order is considered lost, stolen or undelivered, Glowthie will offer either a replacement order or a refund, according to the Client's preference.

If a refund is chosen, the procedure outlined in Section 10.3 (Refund Methods) will be followed.

Claims for undelivered orders will not be accepted if the courier's tracking system confirms the order as delivered or the Client fails to comply with the deadlines and procedures for notification.

9. RIGHT OF FREE CONTRACT TERMINATION
Under Articles 10 and 11 of the legal regime governing distance and off-premises contracts, the Client has the right to withdraw from the contract without the need for justification within 14 days. This period starts from the date the Client or a third party (other than the courier) physically receives the goods. For orders with multiple items delivered separately, the period begins on the date the last item is received
 
9.1. Exercising the Right of Termination 
To exercise this right, the Client must clearly and unambiguously communicate their intention to withdraw from the contract, either via email or letter. It is recommended to contact Glowthie's Customer Support service through the website (www.glowthie.com) before proceeding.
Required information includes:
  • Order number;
  • Description or reference of the product(s) to be returned;
  • The preferred refund method.

To simplify the process, Glowthie provides a withdrawal form, which can be downloaded directly from [HERE]
Detailed instructions on the return process are included in the form's appendix and reiterated in Section 9.3 (Product Returns) and Section 10.1 (Returns).

Note: To comply with the 14-day deadline, the withdrawal communication must be sent before the end of this period.

9.2. Effects of Contract Termination

Upon valid exercise of the right of withdrawal, all amounts paid by the Client, including delivery charges, will be refunded, except for the following:

  1. Additional costs incurred by choosing a more expensive delivery option instead of the least expensive standard delivery method provided by Glowthie;
  2. Direct costs of returning the products, which are always borne by the Client.

Refunds will be processed without undue delay and no later than 14 days after the receipt of the returned products. The refund will be made using the same payment method used for the initial transaction unless otherwise agreed.

Note: If the Client used a promotional discount code, the corresponding value will not be refunded. The refund will be limited to the amount actually paid.

9.3. Product Returns

Returned products must be sent to Glowthie's warehouse at: Rua de Alvre, n.º 14, 4740-013 Esposende, Portugal

Returns can be made in two ways:

  1. Request Glowthie to collect the items: The Client can request the collection of the items by Glowthie, with the associated costs borne by the Client.
  2. Direct return by the Client: The Client can opt to return the products directly to the warehouse at the above address.

Returns must be made without undue delay and no later than 14 days after the communication of withdrawal. The deadline will be considered met if the items are shipped before the end of this period.

9.4. Conditions for Accepting Returns

To ensure acceptance of returns and the processing of refunds, the following conditions must be met:

  • Product condition: Products must be returned without signs of improper use. Depreciation caused by handling beyond what is necessary to verify the nature, characteristics, and functioning of the products will be considered, which may result in a proportional reduction in the refund amount.
  • Original packaging and components: Products must be returned in their original packaging, in good condition, with all accompanying documentation and any free items (such as promotional gifts) included in the order.
  • Item integrity: Missing components or items not in their original state will result in the denial of a refund.

The Client is responsible for the proper care of the items until they are returned. For any questions regarding the process, it is advisable to contact Glowthie’s Customer Support team.

10 - RETURN AND EXCHANGE PROCEDURE

10.1. Returns
Customers who wish to return purchased products must strictly observe the previously established conditions.
If the purchase was made during a promotional campaign that included products offered as gifts, the joint return of the main item and the offered product will be mandatory. Both items must meet the stipulated conditions for acceptance of the return.
The return may be refused if the conditions are not met, with the Customer being responsible for the reshipment costs or the possible destruction of the returned and unaccepted products.

Conditions for return acceptance:
Returns will not be accepted for products that:

  1. Are incomplete, damaged, or without the original packaging;
  2. Show signs of improper use;
  3. Fall into the following categories:
    • Promotional products or products purchased with loyalty points;
    • Products with an expiration date of less than 3 (three) months;
    • Products whose packaging or protective seals have been removed;
    • Gift cards and discount vouchers.

Glowthie will assess the integrity of the returned products to determine whether they meet the conditions for acceptance. If not, the Customer will be notified and will have a period of 10 days to collect the products from the warehouse indicated, bearing the associated collection costs.

10.2. Exchanges
In general, exchanges are not allowed. To make a replacement, the Customer must return the product, request a refund, and make a new purchase, which will be subject to the conditions in effect on the date of the transaction.
The return process is detailed in the previous section (10.1. Returns).

10.3. Refund Methods
Refunds will be processed within a maximum period of 15 business days after receipt of the returned products at the warehouse. The amount will be refunded using the same payment method used for the purchase, unless otherwise indicated by the Customer.

Refund methods and additional conditions:

  • Credit card: The refund will be credited directly to the card used for the purchase.
  • Other payment methods: The Customer will be asked to provide bank details, including IBAN and SWIFT, along with proof of account ownership.
  • Discount coupon: Alternatively, the Customer may opt for a discount coupon valid for 12 months. After the coupon expires, no further refund requests will be accepted.

Note: Some payment methods may have limitations regarding the issuance of refunds after certain periods. In such cases, it will be necessary to provide a bank account for the transfer of the corresponding amount.

10.4. Return Costs
Glowthie will cover the return costs in the following cases:

  1. Shipping error: Product sent incorrectly.
  2. Product defect: Product with proven damage or defects.

In these cases, Glowthie will arrange for the collection of the product, with prior coordination through Customer Support.

11 - SPECIFIC CONDITIONS FOR THE SALE AND PROCESSING OF ORDERS

Glowthie adopts strict processes to ensure the accuracy of the information presented on the website, including descriptions, prices, and promotional campaign conditions, in compliance with legal requirements. However, in situations where errors in the publication of information are identified, such as incorrect prices or invalid campaigns, Glowthie may refrain from processing orders associated with these products. In such cases, the Customer will be promptly notified by the Customer Support team about the inability to proceed with the order.

11.1. Reasons for Order Cancellation or Modification
Orders may not be processed or may undergo changes due to reasons such as:

  • Stock shortage: Products unavailable at the time of order preparation;
  • Payment issues: Failure in payment authorization, execution, or validation;
  • Suspicious activity: Detection of possible fraud or irregularities in the order.

11.2. Compliance with the Legislation of the Destination Country
The Customer is responsible for verifying that the products purchased comply with the applicable legislation in the delivery country. Some local restrictions may limit the marketing or importation of certain items. Whenever such restrictions are identified before shipment, the Customer will be informed about the inability to process the order.

11.3. Promotional Campaigns and Special Conditions
All promotional campaigns, offers, or discounts are subject to stock availability and the specific conditions stipulated for each campaign.

11.4. Operational Errors and Restrictions on Sale
Glowthie reserves the right not to complete the processing of orders in cases such as:

  • Computer system errors: Technical failures affecting the accuracy of prices, descriptions, or product availability;
  • Logistical problems: Difficulties in the preparation, transportation, or delivery of the order;
  • Legal or administrative restrictions: Prohibitions imposed by competent authorities on the sale or shipment of specific products to the requested destination.

11.5. Use of Discount Coupons
Discount coupons, accumulated credits from previous purchases, benefits associated with promotional campaigns, or compensations are subject to the conditions established on the activation date.

Conditions for the use of coupons and credits:

  • Validity: Coupons may only be used within the stipulated period;
  • Stock availability: Products purchased with coupons are subject to availability at the time of purchase;
  • Legal compliance: The use of coupons must comply with the regulations applicable to the transaction.

Important note: If the coupon or credit is applied to orders that are subsequently canceled or modified, the corresponding amounts will be adjusted according to the conditions in effect on the order date.

12 - WARRANTY
Glowthie guarantees the compliance and quality of the cosmetic products sold, in accordance with the applicable Portuguese legislation. In the event of proven non-conformity in the purchased cosmetic products, the Customer will be entitled to one of the following solutions:
  1. Replacement of the product with an identical one, provided it is available in stock;
  2. Replacement with a similar product, subject to prior agreement with the Customer;
  3. Contract termination, with the subsequent refund.
12.1. Requirements for Warranty Activation
The warranty can be activated up to 48 hours after receipt of the product, upon presentation of proof of purchase (invoice) and evidence of non-conformity, such as photographs or videos sent to Customer Support.
The Customer must keep the original packaging for a period of 30 days after delivery to facilitate possible returns.
 
12.2. Warranty Exclusions
The warranty will not apply in the following situations:
  1. Improper use or negligence on the part of the Customer, including incorrect application of the products;
  2. Incorrect storage, such as exposure to unsuitable conditions (e.g., humidity, extreme heat, or direct sunlight);
  3. Products with natural wear and tear, as long as they are within the limits specified by the manufacturer;
  4. Handling or tampering with the product, such as improper opening, removal of safety seals, or attempts to modify the content.
Important note: For cosmetic products, situations involving allergic reactions or individual intolerances are not covered by the warranty. It is recommended that Customers carefully read the usage instructions and ingredient list before application.
 
12.3. Collection and Analysis Process
Products deemed eligible for warranty will be collected by Glowthie at no additional cost to the Customer. After technical analysis, the Customer will be informed of the result and the applicable solution (replacement, refund, etc.).
NOTE: The refund process will be carried out in accordance with the terms defined in Section 10.3 (Refund Methods) unless otherwise agreed with the Customer.
 
13 - SUGGESTIONS AND COMPLAINTS
Glowthie values its Customers' opinions and uses them as fundamental tools for the continuous improvement of the services and products offered. Customers who wish to share suggestions or express dissatisfaction may do so with the Customer Support department, following the procedures described below.
 
13.1. Deadline for Complaints
  • General complaints must be submitted within a maximum period of 14 days after receiving the order.
  • Complaints related to defective, damaged, or exchanged products must be submitted within 48 hours after receiving the order.

Required documentation: Photographs or videos that prove the defect or damage identified in the product, as well as the condition of the packaging and the transport box at the time of delivery.

Conservation of the product being claimed: The Customer must keep the product in their possession, along with its packaging, until Customer Support provides instructions on the next steps.

Additional notes: For detailed information on the conditions for receiving orders, please refer to Section 8.7 (Conditions for Receiving Orders and Claims for Transport Damage) of this document.

We emphasize that if, at the time of delivery, the Customer notices that the package is visibly damaged, it is recommended that they refuse the order. Accepting an order with visibly damaged packaging may compromise the acceptance of a subsequent complaint.

13.2. Resolution and Compensation
If the complaint is validated, the following compensation measures may be applied:

  • Sending a replacement product;
  • Issuance of a discount coupon.

Coupon validity: The Customer must respect the validity period indicated on the coupon to avoid issues related to stock availability or other restrictions.

13.3. Online Complaints Platform
Glowthie is registered on the Online Complaints Book Platform, allowing Customers to submit official complaints through the page www.livroreclamacoes.pt.
The Customer Support department is available to assist throughout the complaint process or to receive suggestions.

14 - ALTERNATIVE DISPUTE RESOLUTION (ADR)
Glowthie informs that, in the event of a dispute, consumers have the right to seek resolution through Consumer Alternative Dispute Resolution (ADR) entities.

15 - INTELLECTUAL PROPERTY
The Glowthie website, as well as the services provided through it, are the exclusive property of the company and are fully protected by applicable laws.
 
The User or Customer acknowledges that all content present on the website, including texts, images, graphics, logos, designs, codes, and other elements, is protected by copyright, related rights, industrial property, and other legal provisions related to intellectual property.
 
It is also acknowledged that any material included in advertising campaigns, promotions, or mentions of sponsors and advertisers is likewise subject to intellectual property laws. Its use is only allowed with the express authorization of the respective holders.
 
15.1. User or Customer Commitment
The User or Customer agrees to:
  1. Respect all rights mentioned in the previous points;
  2. Refrain from any act that constitutes a violation of these rights, including but not limited to reproduction, distribution, modification, commercialization, transmission, or public availability of content without prior express authorization from Glowthie or the respective rights holders.
Failure to comply with these provisions may result in legal liability and the adoption of appropriate legal measures to protect the rights of Glowthie and third parties.

16 - SERVICE SECURITY CONDITIONS
16.1. Responsibilities
The User or Customer must comply with all applicable laws, avoiding illegal practices, such as sending unsolicited communications (spamming) or privacy violations. The User or Customer must act in a way that does not compromise the security and functionality of the service.
Non-compliance may lead to suspension or deactivation of access to the service by Glowthie (see Section 17 - Suspension and Deactivation of the Store Service).

16.2. IP Network Limitations
Glowthie cannot guarantee uninterrupted service due to congestion in the IP network, data loss, or unexpected delays.

16.3. Force Majeure Situations
The company is not responsible for failures caused by unforeseen overloads or events beyond its control, such as natural disasters or issues external to its infrastructure.

16.4. Service Restoration
In the event of interruptions, Glowthie is committed to resolving the issue as quickly as possible and will inform the Users, if necessary, about the service's regularization.
These conditions ensure the responsible and transparent use of the platform.

17 - SUSPENSION AND DEACTIVATION OF THE STORE SERVICE
17.1. Right of Suspension or Termination
Glowthie may discontinue the service, partially or fully, at any time, without prior notice.

17.2. Reasons for Suspension or Termination
Access to the service may be suspended or terminated in the following cases:

  1. Violation of the terms of use by the Customer or User of the Glowthie website;
  2. Glowthie's decision to cease store operations, with a 15-day notice.

17.3. Disclaimer of Liability
Suspension or termination of the service does not entitle the Customer or third parties to any compensation or indemnification. Glowthie is not responsible for any consequences arising from these actions.

17.4. Prior Communication
In case of suspension or termination of the service:

  1. Glowthie will inform the Customer in advance;
  2. A period of 3 business days will be granted for the Customer to save relevant information or content from their order area.

18 - COMMUNICATIONS
Glowthie may send notifications related to the service, including changes to the general terms and conditions, via email, SMS, or phone contact.
The Customer authorizes the sending of communications to the contact details provided at the time of the order (address, phone number, and/or email).

18.1. Cancellation of Communications
The Customer may, at any time, request the cessation of notifications or communications through:

  • The Contact Form available on the website;
  • The "Unsubscribe from the Newsletter" option, available in each edition of the Newsletter.

19 - TECHNICAL SETTINGS
Glowthie reserves the right to modify the service or the applicable rules, communicating these changes to the User at least 15 days in advance.

19.1. Access to Updated General Terms and Conditions
The most recent version of the General Terms and Conditions and attachments will always be available on the official Glowthie website - www.glowthie.com.

19.2. Modifications for Optimization and Adaptation to Technological Innovations
Glowthie may remotely adjust network settings to improve the User experience or optimize connectivity.
Due to the constant technological evolution, Glowthie may modify the technical settings of the service whenever necessary to ensure its adequacy to sector innovations. However, Glowthie cannot ensure or guarantee that Users will receive automatic upgrades or service improvements.

20. Applicable Law

The Contract is governed by Portuguese law.
